Additional Privacy Terms – Accessibility Testing

Data import

For providing “Services” under “Accessibility Testing”, BrowserStack would collect “Customer Content” while using the BrowserStack’s proprietary software-as-a-service solution including any authorized browser extension(s) or the BrowserStack Software Development Kit (SDK).

Data usage

All Data accessed, collected, stored, or used for Accessibility Testing including personal information will be subject to and in accordance with our Privacy Policy and these Additional Privacy Terms for Accessibility Testing. All data used will solely be for the purpose of providing the Services and we will not share your Data with any third parties without your consent.

Data retention

Any Customer Content generated while using Accessibility Testing may be retained for a maximum period of three (3) years from the date a test report was stored on the platform and may be subject to your applicable purchase plan. We may also retain your information to comply with our legal obligations, resolve disputes, and enforce our policies.

Data deletion

If you no longer wish for your personal information to be stored by us, you have the right to request that we delete your information. We will comply with your request in a timely manner, provided that we are not required to retain your information for legal or other legitimate business purposes. Please note that deletion of your data may impact our ability to provide Accessibility Testing offering to you.

Legal disclaimer 

Use of Accessibility Testing (“Accessibility Testing”) and/or any extensions, that depend on third-party services or products for transmitting Data, may be subject to limitations or disruptions caused by the use of such third-party services or products. To the fullest extent permitted by law, BrowserStack shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on Data collected through any such third-party services.

Definition

Data: Data refers to Customer Content for the purpose of this policy.

Customer Content: For the purpose of this policy, the Customer Content also includes artifacts such test name, test details, website data and relevant metadata information which are required for this service to operate.

Consent 

By choosing to use Accessibility Testing you agree to provide BrowserStack the right to access, use, modify and transmit data (“Data import”) from your “Devices” for the limited purpose of using this offering. “Devices” may include any virtual machines, physical electronic devices, and device emulators which you may use to run your tests or host your application under test. BrowserStack will not be responsible for any data stored in your Devices.

You further agree that BrowserStack may use aggregated or anonymized “Customer Content” for any business purpose during or after the term during which you use the offering, including without limitation to develop and improve BrowserStack products and services and to create and distribute insights, reports and other materials.

Further you deemed to have consented to these Additional Privacy Terms including the Terms listed on our Terms of Service and Privacy Policy. These Additional Privacy Terms are incorporated by reference into the Terms of Service or any other agreement between the parties. In case of a conflict between these Additional Privacy Terms and the terms mentioned in the Terms of Service, agreement, and/or Privacy Policy pages, these Additional Privacy Terms shall prevail.
