BrowserStack Services may include one or more Third Party AI Tools for certain AI powered products, capabilities or functionalities on the BrowserStack platform (“AI Features”). Use of such AI Features are subject to the following terms and the same form an integral part of the BrowserStacks’ Terms of Service or in case you have a signed Agreement with Browserstack, then such agreement (“ToS”). Terms used here, but not defined shall have the same meaning as defined in the ToS. In the event of conflict between the ToS and these AI Terms, the AI Terms shall take precedence.
The customer using the AI Features (“Customer”) understands and acknowledges that the AI Features is not mandatory and that BrowserStack Services may be used without enabling the AI Features. Customer may, at any time, choose to opt-out by changing the Account Settings.
BrowserStack currently uses artificial intelligence technology developed by third parties, including the ones listed below. Customer acknowledges and agrees that by using the AI Features, all the terms and policies associated with the Third Party AI Tools also govern its use of the AI Features.

Customer represents and warrants to use AI Features in compliance with all applicable laws, regulations, and guidelines including data protection, privacy, AI regulations, and Third-Party AI Tool terms, or policies. Customer remains responsible for all inputs provided to AI Features, as well as the consequences of using or sharing any AI-generated output.
Customer acknowledges that outputs generated by the AI Features may contain errors, inaccuracies, or omissions. The Customer is responsible for reviewing and ensuring the safety and legality of any content generated using AI Features.
BrowserStack will not use Customer Content for training or fine-tuning Third Party AI Tools. Customer Content processed via AI Features will be used solely for inference or prediction purposes, and will be retained only for as long as reasonably necessary to perform such functions, in accordance with the data retention policies set out in the ToS. BrowserStack may from time to time update, modify, or introduce new AI Features in its Services, subject to the limits in the Agreement and applicable notice or change terms therein.
While BrowserStack implements commercially reasonable safeguards, it does not control or guarantee the performance or security of such third-party providers. BrowserStack shall not be liable for any data loss, breach, or issue arising from the acts or omissions of Third-Party AI Tools. BrowserStack shall have no liability arising out of or in connection with Customer’s access to or use of any AI Features.
If any applicable law, regulation, or local rule governing the use, deployment, or operation of artificial intelligence (including without limitation the EU Artificial Intelligence Act, or any similar national or regional AI framework) imposes additional or different obligations, this Addendum shall automatically be updated, interpreted, and applied to reflect and comply with such local requirements. In such cases, the relevant sections of this Addendum and the Agreement shall be deemed modified to the extent necessary to ensure compliance, and all other provisions shall continue to apply in full force and effect.
WARRANTY AND DISCLAIMERS: THE AI FEATURES ARE ENABLED BY THIRD PARTY AI TOOLS, BROWSERSTACK DOES NOT GUARANTEE THE ACCURACY OF ANY OUTPUT GENERATED BY THE AI FEATURES. CUSTOMER IS REQUIRED TO ASSESS AND EVALUATE THE ACCURACY OF THE OUTPUT GENERATED AND NOT RELY ON BROWSERSTACK TO DO SO. IN ADDITION TO THE DISCLAIMER INCLUDED IN THE TOS, THE AI FEATURE IS PROVIDED ON AN “AS IS” AND AS “AVAILABLE” BASIS. BROWSERSTACK MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE AI FEATURES, OR THE INFORMATION, TEXT, AND CONTENT INCLUDED IN THE OUTPUT, OR THE USE OF THE INPUT, INCLUDING WITHOUT LIMITATION, ACCURACY OF THE RESULTS, AVAILABILITY, SUITABILITY, RELIABILITY, OR CONTENT OF ANY INFORMATION PROVIDED THROUGH THE AI FEATURES. BROWSERSTACK WILL HAVE NO LIABILITY OR RESPONSIBILITY ARISING IN ANY WAY FROM CUSTOMER’S USE OF THE CONTENT OR ANY ERRORS OR OMISSIONS CONTAINED IN THE CONTENT.
