Additional Privacy Terms – Test Management

Data import

By importing Data from a third-party platform or uploading a file, you acknowledge and consent to the transfer of Data including personal information contained in the imported data which will be subject to and in accordance with our Privacy Policy and Additional Privacy Terms for Test Management. We will take all necessary measures to ensure the security of your Data during transfer and processing. We will use your imported Data solely for the purpose of providing the Services and will not share your Data with any third parties without your consent. 

Data usage

All Data accessed, collected, stored, or used for Test Management including personal information will be subject to and in accordance with our Privacy Policy and Additional Privacy Terms for Test Management. All data used will solely be for the purpose of providing the Services and we will not share your Data with any third parties without your consent.

Data retention

Any Customer Content generated while using Test Management may be retained for a maximum period of five (5) years from the date a test report is stored on the platform and may be subject to your applicable purchase plan. We may also retain your information to comply with our legal obligations, resolve disputes, and enforce our policies.

Data deletion

If you no longer wish for your personal information to be stored by us, you have the right to request that we delete your information. We will comply with your request in a timely manner, provided that we are not required to retain your information for legal or other legitimate business purposes. Please note that deletion of your data may impact our ability to provide Test Management offering to you.

Legal disclaimer 

Use of Test Management (“Test Management”) and/or any extensions, that depend on third-party services or products for transmitting Data, may be subject to limitations, errors or disruptions caused by the use of such third party services or products. 

BrowserStack will not be responsible for any disruptions or errors or incomplete Data import resulting from such limitations. When you use a third-party resource for Data import, you will be subject to its terms and licenses and no longer be protected by our privacy policy or security practices. You should familiarize yourself with any license or use terms of, and the privacy policy and security practices of, the third-party resource, which will govern your use of that resource.

To the fullest extent permitted by law, BrowserStack shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third-party resource. BrowserStack disclaims any liability for the content or accuracy, completeness, or reliability of such Data of any third-party resource or for any loss or damage of any sort resulting from the use of, or for any failure of, Data provided at or from a third-party resource on Test Management. 

Definition

Data: Data refers to Customer Content for the purpose of this policy. 

Customer Content: For the purpose of this policy, the Customer Content also includes artifacts such as test related logs, test name, test details and metadata information which are required for this service to operate.

Consent 

By choosing to use Test Management, you are deemed to have consented to these Additional Privacy Terms including the Terms listed in our Terms of Service and Privacy Policy. These Additional Privacy Terms are incorporated by reference into the Terms of Service or any other agreement between the parties.  In case of a conflict between these Additional Privacy Terms and the terms mentioned in the Terms of Service, agreement, and/or Privacy Policy pages, these Additional Privacy Terms shall prevail.
